Terms of Service

These terms govern your engagement of Capital Gains Tax Valuations Pty Ltd ("we", "us") for the provision of property valuation services. By accepting a quote or instructing us to proceed, you agree to be bound by these terms together with any specific scope of work recorded in the quote.

Scope of work

Each engagement is for the preparation of a single, signed valuation report addressing the purpose, valuation date and property identified in the quote. Any change to the purpose, property, valuation date, or report addressee is a separate engagement and may require an additional fee.

Fees and payment

Fees are fixed and quoted in advance, inclusive of GST unless otherwise stated. Invoices are payable within 7 days of issue. Reports are released on receipt of cleared payment unless prior credit terms have been agreed in writing.

Reliance and intellectual property

Our reports are prepared solely for the named addressee and the stated purpose. No third party may rely on the report without our prior written consent. We retain copyright in all reports, working papers and methodology; you receive a licence to use the report for the stated purpose only.

Limitation of liability

To the extent permitted by law, our total liability arising out of or in connection with any engagement is limited to the amount of fees paid for that engagement. We are not liable for consequential, indirect or economic loss. Nothing in these terms excludes any consumer guarantee that cannot lawfully be excluded under the Australian Consumer Law.

Professional standards

All valuations are prepared by Certified Practising Valuers (CPV) and comply with the Australian Property Institute Professional Practice Standards, the International Valuation Standards (IVS) and, where relevant, the ATO's Market Valuation for Tax Purposes guidelines.

Cancellation

If you cancel an engagement after instruction but before delivery, you remain liable for work already performed, calculated on a pro-rata basis. Cancellation after inspection attracts the full inspection component of the fee.

Governing law

These terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
